GENERAL TERMS AND CONDITIONS
All services provided by the Provider to the Customer* shall be performed exclusively on the basis of the following General Terms and Conditions. Deviating provisions shall only apply if they have been agreed in writing between the Provider and the Customer.
2. APPLICATION OF THE TERMS AND CONDITIONS AND CONCLUSION OF THE CONTRACT
These General Terms and Conditions (GTC) apply to purchase contracts with private customers* and companies, which are concluded via japanischwohnen.ch.
By ordering the desired goods on japanischwohnen.ch, the customer* makes a binding offer to conclude a purchase contract.
The order is confirmed by the provider. The contract is concluded as soon as the confirmation is received by the customer*. If the confirmation is not received within a reasonable period of time, the customer* shall regard this as a rejection of the order and shall be entitled to conclude the contract with another supplier.
For purchase contracts concluded by other means, e.g. by telephone, fax or letter, these GTC shall also apply.
3. PRICES AND SPECIAL OFFERS
Within Switzerland a fee of 9 francs per order will be refunded. From 100.- the shipment is free of charge. The agreed price covers in particular packaging, transport, expenses and all public charges including value added tax.
For international shipments, different shipping prices apply depending on the region. The agreed price includes in particular the packaging, the expenses, as well as all public charges excluding value added tax. The value added tax is not levied by Japanese Living and is to be paid to the supplier upon receipt.
The Supplier reserves the right to change prices at any time. For the customers*, the prices published on the website on the order date shall apply.
The terms and conditions of promotions and discounts are available at the appropriate time with the relevant information.
4. PACKAGING AND SHIPPING COSTS
Deliveries within Switzerland are made by Swiss Post.
The published price includes the cost of packaging and shipping by PostPac Economy (B parcel post).
5. DELIVERY CONDITIONS
The shipment of the ordered goods will be made after receipt of payment.
Delivery within Switzerland is normally made within 3-5 working days.
In the event of delays in delivery, such as force majeure, traffic disruptions and orders from higher authorities, as well as other events for which the provider is not responsible, no claim for damages can be made against the provider.
The customer has the possibility to pay with Visa, MasterCard, PayPal and TWINT.
7. RESERVATION OF OWNERSHIP
Until full payment, the goods remain the property of the provider.
8. LIABILITY FOR ONLINE CONNECTIONS
The Provider undertakes to ensure security in accordance with the current technical state of the art in systems, programs, etc., which belong to him and over which he has influence, as well as to comply with the rules of data protection.
Customers* are responsible for the security of systems, programs and data within their sphere of influence. In their own interest, customers* should keep passwords and user names secret from third parties.
The Provider shall not be liable for defects and malfunctions for which it is not responsible, in particular for security defects and operational failures of third-party companies with which it cooperates or on which it is dependent.
Furthermore, the Provider shall not be liable for force majeure, improper actions and disregard of risks on the part of the Customer or third parties, excessive use, unsuitable operating resources of the Customer* or third parties, extreme environmental influences, interventions by the Customer* or disruptions by third parties (viruses, worms, etc.) that occur despite the necessary current security precautions.

10. APPLICATION OF LAW AND PLACE OF JURISDICTION
These GTC and the contracts concluded on the basis of these GTC shall be governed by Swiss law, namely the provisions of the Swiss Code of Obligations (OR), excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
11. FINAL PROVISIONS
Should one or more provisions of these GTC be invalid, this shall not entail the invalidity of the entire contract. The invalid provision shall be replaced by the relevant statutory provision.
